Tomlinson PSD & Fiesta Tableware Hearing Continued

The hearing between Tomlinson Public Service District and Fiesta Tableware over water/sewage rates has been delayed. The hearing was originally slated for August 14, 2024 in the Weirton City Building Council Meeting Room. In asking for the delay, Tomlinson states that both their Attorney Tom Decapio and their accountant Todd Dingess will be out-of-the-country. Fiesta Tableware’s Attorney has indicated no problem with the delay.

  • BEFORE THE PUBLIC SERVICE COMMISSION OF WEST VIRGINIA CASE NO: 20-1033-WS-DU THE NEWELL COMPANY TOMLINSON PUBLIC SERVICE DISTRICT and HANCOCK COUNTY PUBLIC SERVICE DISTRICT, Petition for determination that Company is a distressed or failing utility under W. Va. Code §24-2H-6(a) MOTION TO CONTINUE AUGUST 14,2025 HEARING NOW comes Tomlinson Public Service District, (hereafter “Tomlinson”) by counsel, and respectfully requests that the hearing scheduled in the above referenced case set for August 14, 2025, be continued. In support of said request Tomlinson states as follows: 1. By Order dated June 6, 2025, this matter was set for hearing on August 14,2025 in order for comments and hearing in regards to Tomlinson’s request that the Commission make a recommendation to the Water Development Authority that Tomlinson be awarded the sum of Five Million Dollars ($5,000,000.00) from the Distressed Utilities Account. 2. Both the accountant for Tomlinson and Counsel for Tomlinson will be out of the country on vacation on the date of the hearing. Both Todd Dingess, CPA and Thomas J. Decapio, Esquire, are both necessary participants at the hearing. 3. Staff attorney Chris Howard has indicated that he does not object to the granting of this Motion. 000004
  • WHEREFORE, based upon the foregoing, The Tomlinson Public Service District respectfully requests that an Order be entered that continues the above referenced hearing set for August 14, 2025 and for any further relief that is proper.
