Fiesta and Tomlinson PSD Reach Agreement

Fiesta Tableware Company and Tomlinson PSD have reached an agreement on interim rates charged Fiesta for potable water. On January 31, 2025 Fiesta claimed that Tomlinson was unable to provide non-potable water for Fiesta’s operations. Fiesta requested the Public Service Commission establish an interim rate until Tomlinson was able to provide non-potable water.

On Sept. 26, the two parties entered into mediation and on Sept. 29 reported mediation was successful and an agreement had been reached. On October 8, the parties filed their stipulation and requested the PSD adopt it to resolve the complaint.

Under the stipulation, Tomlinson will provide water to Fiesta at a rate of $5.60 per thousand gallons for the first million gallons and $3.12 per thousand gallons thereafter, effective from Dec. 24, 2024. Fiesta will pay a minimum bill of $5,600 if its usage is less than one million gallons per month. Fiesta agreed to eliminate an arrearage calculated using the agreed rate over a five-month period once the stipulation is approved.

In issuing the order, the Public Service Commission wrote “The Stipulation appears to balance the needs of Tomlinson PSD with the economic interests of the complainant. The Commission also takes the opportunity to commend the parties for their efforts to resolve the dispute through mediation.”
